1. The "SSK BHARAT BUSINESS BUILDING INITIATIVE PRIVATE LIMITED", herein after also referred to as “SSK BHARAT BBI”, “SSK-BBI”, "our" or "we". These evolving Terms of Service ("TOS") apply to your use of SSK BHARAT BBI services provided through our SSK BHARAT BBI and/or it’s Mobile App (collectively referred to as "SSK BHARAT BBI"). The Services include SSK BHARAT BBI's related websites, SMS, APIs, email notifications, applications (web and/or mobile), buttons, widgets, ads, commerce services, and any other related services that can be accessed via our SSK BHARAT BBI Sites or that link to these To (collectively referred to as "Services"), and any information, text, links, graphics, photos, videos, or other materials or arrangements of materials uploaded, downloaded or appearing on the Services (collectively referred to as "Contents"). The SSK BHARAT BUSINESS BUILDING INITIATIVE PRIVATE LIMITED manages your personal data in relation to BBI's management system. By using the SSK BHARAT BBI Sites and Services, you agree to be bound by these TOS. You should expect frequent changes to these TOS, and with such changes, your use, rights, and privacy expectations may also change.
2. English Version Controls. In case of any inconsistency between any terms of this contract and any translation into another language, the English version will govern and prevail on any question of interpretation or otherwise
3. Who May Use the Services? You may use the SSK BHARAT BBI Sites and Services if you are a member of SSK BHARAT BBI in good standing, agree to these TOS, and your jurisdiction's law allows you to enter into agreements with third parties. However, you are not allowed to use the SSK BHARAT BBI Sites and Services if (a) you are legally incapacitated for any reason (mental disability, intoxication, under the age of 18, etc.), or (b) you are no longer or not yet a member in good standing of SSK BHARAT BBI. If you are accepting these TOS and using the SSK BHARAT BBI Sites and Services on behalf of a company, organization, government, or other legal entity, you represent and warrant that you are authorized to do so
4. Privacy. Our Privacy Policy, accessible at https://sskbbi.in/privacy.html, explains how we collect, process, store, and share the information you provide to us when you use our SSK BHARAT BBI Sites and Services. By using the Services, you acknowledge that your personal data will be collected and used as described in the Privacy Policy, including the transfer of your data to any of our other organization or any other organization for storage, processing and use by SSK BHARAT BBI, its franchisees and members, associates, subsidiaries, sister concern and its affiliates
5. Payment of Services: You are required to pay for our services in advance. Payments can be made via Government Authorised online methods, cheque and/or the Payment links of our Bank Account provided by us.
6. Refund Policy: We do not offer refunds for our services, except in cases where we fail to provide the agreed-upon service
7. Below are the services that SSK BHARAT BBI shall provide and you hereby agree to adhere the conditions hereto:
• There will be four meetings in a month
• There will be two online meetings/sessions per month and two offline meetings/sessions per month on Thursdays
• Online meetings/sessions will be held on the first and third Thursdays of each month, while offline meetings/sessions will be held on the second and fourth Thursdays of each month
• The meeting is scheduled to start promptly at 8 a.m. in the morning at the predetermined venue
• Online meetings offer excellent opportunities to learn about various aspects of business and personal development, among other things. Although attendance is not mandatory, these sessions provide fantastic learning opportunities. In addition, recorded videos of the sessions will be made available to you for later reference through available mediums
• Attendance at all offline meetings is mandatory, and a maximum of six leaves with valid reasons will be granted over a six-month period, with one leave per month. Failure to comply with this attendance policy will result in termination of membership for the respective module
• Members may appoint a representative as a 'proxy' for a meeting, provided that the module director is informed in advance and approves the arrangement
• The module director, assistant director, and associate director appointed by SSK BHARAT BBI are authorized to address any queries or concerns related to the module.
• Once paid, membership fees are non-refundable, and membership is non-transferable, even if a member leaves the module or their membership is terminated.
• Members are required to arrive on time for offline meetings. If a member is more than 15 minutes late, they will not be allowed to attend the meeting
• We advise all members to dress formally for the meetings, preferably in a blazer or Nehru jacket. Casual attire such as jeans and T-shirts are not permitted, and female members are expected to dress in proper traditional or formal western attire
• SSK Bharat Business Building Initiative Pvt. Ltd. reserves the right to establish and modify rules, regulations, codes of conduct, approvals, rejections, and cancellations related to any member or the business.
• Any dispute is subject to Mumbai's jurisdiction only
• By consenting to these terms, you acknowledge that SSK BHARAT BBI has the final authority to determine the venue and associated charges for offline meetings.
8. Services Content Guidelines
• As a user of SSK BHARAT BBI website and Services, you are responsible for the Content you provide and must comply with all applicable laws, rules, and regulations. Do not submit any Content unless you are willing to take responsibility for it
• You should be cautious when using or relying on any Content or materials found on the Internet, including those on SSK BHARAT BBI website. Your use of the Content and SSK BHARAT BBI website is at your own risk
• Users of the Services are expected to behave ethically, lawfully, and professionally at all times. They should not engage in discourteous, deceptive, misleading, or unethical practices. You are solely responsible for any comments or posts you make on SSK BHARAT BBI website or on any other SSK BHARAT BBI tool. SSK BHARAT BBI does not control the content posted and does not guarantee its accuracy, integrity, or quality. By using the website or the Services, you may come across Content that you find offensive, indecent, or objectionable, SSK BHARAT BBI will not be held liable in any way for any Content, including errors or omissions in any Content or any loss or damage incurred as a result of using any Content posted or made available through the SSK BHARAT BBI website or Services.
• Examples of unethical or unlawful activities include false, misleading, or disparaging statements about SSK BHARAT BBI or any person or entity using the SSK BHARAT BBI website or Services; unauthorized use of SSK BHARAT BBI's name, logo, trademark, or copyrighted material; and violation of federal, state, or local and national laws or regulations
• Spamming, which involves indiscriminate sending of unsolicited bulk messages through electronic messaging systems, is strictly prohibited by SSK BHARAT BBI and may result in immediate account termination. Spamming may also be illegal under applicable laws and may subject you to civil or criminal penalties
• You hereby agree not to use the SSK BHARAT BBI website or Services to upload, post, email, transmit, or otherwise make available any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of privacy, hateful, or racially, ethnically, or otherwise objectionable Content, or any Content that harms minors in any way. You also agree not to impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity; forge headers or manipulate identifiers to disguise the origin of any Content; upload, post, email, transmit, or otherwise make available any Content that you do not have the legal right to make available; infringe any patent, trademark, trade secret, copyright, or other proprietary rights of any party; upload, post, email, transmit, or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," or any other form of solicitation or promotion; upload, post, email, transmit, or otherwise make available any material that contains malicious software; interfere with or disrupt the Site, Services, or servers or networks connected to them; violate any applicable laws or regulations; or "stalk" or harass another person.
• SSK BHARAT BBI reserves all the rights to screen, refuse, move, or remove any Content that violates the TOS or is objectionable, at its sole discretion
• The use of any content on the SSK BHARAT BBI website or in connection with the Services comes with associated risks, and you bear responsibility for these risks, including any reliance on the accuracy, completeness, or usefulness of the content
• SSK BHARAT BBI may access, preserve, and disclose your account information and content if required to do so by law or in good faith belief that such access, preservation, or disclosure is reasonably necessary to comply with legal process, enforce the provisions of the TOS, respond to claims of content violations, respond to customer service requests, or protect the rights, property, or personal safety of SSK BHARAT BBI, its users, and the public.
• The Services and software within the Service may include security components that allow digital materials to be protected, and the use of such materials is subject to usage rules set by SSK BHARAT BBI and/or its technology providers. Any attempt to override or circumvent these rules is prohibited
• As a service provider, SSK BHARAT BBI is not responsible for the content posted by its users on the SSK BHARAT BBI websites, and it may not monitor or control such content.
• SSK BHARAT BBI does not endorse, support, represent, verify, or guarantee the completeness, truthfulness, accuracy, or reliability of any content or communications posted on the SSK BHARAT BBI websites and Services, including any opinions expressed. Users may encounter offensive, false, misleading, deceptive, or otherwise inappropriate content, and all content is solely the responsibility of the user who authored or published it.
• SSK BHARAT BBI is an intellectual property owner and respects the intellectual property rights of others. SSK BHARAT BBI reserves the right to remove content alleged to be infringing without prior notice, respond to notices of alleged copyright and trademark infringement, and provide instructions for reporting and responding to infringement allegations. 
9. Your Rights
• As a user of the SSK BHARAT BBI websites and Services, you are responsible for any content you submit or post, including opinions, photos, videos, logos, and other material. By submitting or posting content, you grant SSK BHARAT BBI a worldwide, non-exclusive, royalty-free license to use it for its business interests, and you acknowledge that any content submitted may be used to create Relationship Data related to SSK BHARAT BBI Members, which is owned exclusively by SSK BHARAT BBI.
• SSK BHARAT BBI owns the member relationship and Relationship Data and your performance data may be shared with other Modules, and Relationship Data may also be shared.
10. Services and content:
    Please take note that when you submit or post Content through SSK BHARAT BBI's websites and Services, you are granting SSK BHARAT BBI a worldwide, non-exclusive, and royalty-free license (with the right to sublicense) to use it for SSK BHARAT BBI's business purposes. You acknowledge that submitted Content, along with any existing Content, can be used to create Relationship Data related to SSK BHARAT BBI Members. You agree that Relationship Data is solely owned by SSK BHARAT BBI, and no one, including you, can use this data without SSK BHARAT BBI's express written consent. This acknowledgment of SSK BHARAT BBI's ownership of Relationship Data is to prevent others from creating competing network groups using the Content that SSK BHARAT BBI has invested significant resources in collecting and sorting for its business interests
11. Using the Services
• You may only use the Services in compliance with these Terms of Service and all applicable laws, rules, and regulations. SSK BHARAT BBI's Services are continually evolving and may change at any time, at our discretion and in accordance with our terms. SSK BHARAT BBI has the right to stop providing Services or any features within the Services permanently or temporarily, to you or any user. SSK BHARAT BBI may also limit the use and storage of Services at its sole discretion and remove or refuse to distribute any Content via the SSK BHARAT BBI websites and Services, suspend or terminate users, and reclaim usernames without liability to you
• SSK BHARAT BBI reserves the right to access, read, preserve, and disclose any information it reasonably believes is necessary to (i) comply with applicable law, regulation, legal process, or government request, (ii) enforce the Terms of Service, including investigating potential violations, (iii) detect, prevent, or address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect the rights, property, or safety of SSK BHARAT BBI, its users, and the public. SSK BHARAT BBI does not disclose personal identifying information to third parties except in accordance with its Privacy Policy
• You are not authorized to develop the SSK BHARAT BBI websites and Services
12. Your Account
    To use the online Services on the SSK BHARAT BBI websites, you need to join SSK BHARAT BBI and create a SSK BHARAT BBI online account. You are responsible for safeguarding your SSK BHARAT BBI account by using a strong password and limiting its use to this account. SSK BHARAT BBI is not liable for any loss or damage resulting from your failure to comply with these requirements
13. Terminating the Terms of Service
• If you wish to terminate your agreement and membership with SSK BHARAT BBI, you can do so at any time by deactivating your accounts and ceasing the use of the Services. SSK BHARAT BBI has the right to suspend or terminate your account or stop providing you with all or part of the Services for any reason, including if:
1. you have violated these TOS
2. you pose a risk or potential legal exposure to SSK BHARAT BBI
3. your account is inactive for an extended period
4. your membership has expired or terminated, or
5. Providing Services to you is no longer commercially viable. We will try to notify you by the email address associated with your account or when you next try to access your account, depending on the circumstances
• In all such cases, the TOS will terminate, and your license to use the Services will expire
14. Third-Party Beneficiaries
• By agreeing to these TOS, you acknowledge that it is not a contract between you and Apple®, Google®, or any other third party. SSK BHARAT BBI allows you to use the SSK BHARAT BBI website on an iOS or Android product that you own or control and according to that product's applicable usage rules. If the SSK BHARAT BBI website (Business Intelligence) do not meet any applicable warranty, you can ask Apple®, Google®, or another relevant third party for a refund of your purchase price, if applicable, for the SSK BHARAT BBI websites, to the maximum extent allowed by law. SSK BHARAT BBI will provide maintenance and support services to the SSK-BBI websites. If you have any intellectual property or other claim related to the SSK-BBI Sites, please contact BBI at grievance@sskbbi.in
• Apple, Google®, and their subsidiaries are third-party beneficiaries of these To and the Privacy Policy. When you accept these terms, you agree that these third-party beneficiaries have the right (and will be considered to have accepted the right) to enforce these TOS against you
15. Fees and Payments
• If you become a member of a SSK BHARAT BBI Module, you will be granted access to our SSK BHARAT BBI website, and you agree to pay all fees associated with the membership. Additionally, the SSK BHARAT BBI website are only available to SSK BHARAT BBI members in good standing
• When you order a service, you will have the opportunity to review and accept the fees that will be charged. Prices, availability, and other purchase terms are subject to change without prior notice. SSK BHARAT BBI reserves the right to discontinue or modify the specifications and prices of services offered on and outside of the SSK BHARAT BBI website without incurring any obligation to you. All fees may be subject to taxes applicable at the time of service requested. The SSK BHARAT BBI reserved rights to apply all the required government taxes to the membership fees
16.  Ordering Services
• When ordering services through the SSK BHARAT BBI website or other means, it is your responsibility to provide truthful, accurate, current, and complete information. Payment must be received before your order can be accepted. SSK BHARAT BBI may need to verify the information you provide, and reserves the right to cancel or limit your order at any time after it has been placed
• Permission must be obtained in advance from SSK BHARAT BBI before sending any automated queries to the SSK BHARAT BBI website or its systems
• For any information or content, you submit, you represent and warrant that: (i) you have the right to submit the content to SSK BHARAT BBI and grant the licenses as outlined; (ii) no licenses from third parties or royalties are required by SSK BHARAT BBI; (iii) the content does not infringe on any third party's intellectual property or privacy rights; and (iv) the content complies with all applicable laws and this agreement. If the information or content relates to a third party, you also represent and warrant that you have obtained the necessary consent, will notify the third party of any breaches, and will update SSK BHARAT BBI if the third-party changes or withdraws consent.
• All content on the SSK BHARAT BBI websites and related to the Services, including text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is the property of SSK BHARAT BBI or its content suppliers and is protected by the copyright laws in India. All software used on the Site is the property of SSK BHARAT BBI or its software suppliers and is protected by the copyright laws applicable in India. The trademarks, service marks, logos, brand, and trade names on the Site are the proprietary intellectual property of the owners of such marks, logos, or names and may not be used, modified, removed, or infringed upon. SSK BHARAT BBI retains ownership rights with respect to the Site and the Services, including design, functionality, and documentation. You may not copy, edit, or reproduce any part of the Site or the Services
17. Defense and Indemnification
    You will be responsible for defending, compensating, and holding harmless SSK BHARAT BBI and its affiliates (including their employees, directors, agents, and representatives) from any and all claims, costs, losses, damages, judgments, penalties, interest, and expenses (including reasonable legal fees) that arise from or are related to:
• your use of the website or Services
• any actual or alleged violation of your commitments, warranties, or obligations mentioned in this TOS

19. Disclaimer of Warranties.
    The SSK BHARAT BBI Sites and the Services are provided on an "as is" and "as available" basis. SSK BHARAT BBI makes no representations or warranties of any kind, express or implied, regarding the Website, the Services, or the content thereof. SSK BHARAT BBI disclaims all warranties to the fullest extent permitted by applicable law, including but not limited to:
• Any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement
• That the website or the Services will meet your requirements, will always be available, accessible, uninterrupted, timely, secure, or operate without error

1. No Resale Right.

Trademark Infringement Report

To report a violation of a trademark to SSK BHARAT BBI, please follow the provided instructions. If you hold a valid and registered trademark or service mark and believe that your mark has been infringed upon, SSK BHARAT BBI requests that you substantiate your claim by providing specific information, such as the mark in question, its registration number, the geographic area to which the mark applies, and evidence that the alleged infringer is a SSK BHARAT BBI user.

Upon receiving this information, SSK BHARAT BBI will investigate the claim and forward the complaint to the alleged infringer. If SSK BHARAT BBI finds the claim to be legitimate, it may remove the infringing material from the site and suspend the alleged infringer's account. • Sufficient evidence that the owner of the website that is claimed to be infringing is a SSK BHARAT BBI user/member
• The precise location of the infringing mark, including electronic mail address, etc
• A good faith certification, signed under penalty of perjury, stating
• The content of the website (identify website] infringes the rights of another party
• The name of such said part
• The mark identify mark being infringed, and
• That use of the content of the website claimed to be infringing at issue is not defensible
• Your trademark claim will not be effective until it is delivered by the U.S. Postal Service or other delivery service to the following address:

• Upon receipt of the appropriate information for trademark claims, SSK BHARAT BBI will initiate an investigation and forward the Complaining Party's written notification to the alleged infringer. While SSK BHARAT BBI is investigating the claim, SSK BHARAT BBI, at its sole discretion and without any legal obligation to do so, may temporarily remove the allegedly infringing material from the website.
• If SSK BHARAT BBI concludes that the Complaining Party has raised a legitimate trademark claim, it may, at its sole discretion and without any legal obligation to do so, permanently remove the challenged material from the Website and suspend the alleged infringer's SSK BHARAT BBI account. If SSK BHARAT BBI concludes that the Complaining Party has not raised a legitimate claim, SSK BHARAT BBI will restore access to the allegedly infringing material
• To provide a Counter Notice to Trademark Infringement, you (the alleged infringer) must provide the following information to SSK BHARAT BBI
  
1. A signature of the alleged infringer (i.e., your signature).
2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
3. A statement under penalty of perjury that the alleged infringer has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled
4. The alleged infringer's name, address, and telephone number, and a statement that the infringer consents to the jurisdiction of the Federal District Court for the Maharashtra District of India
5. To substantiate the claim, SSK BHARAT BBI requires the following information from the Complaining Party:
6. The trademark, service mark, trade dress, name, or other indicia of origin ("mark") that is claimed to be infringed, including registration number
7. The jurisdiction or geographical area to which the mark applies
8. The name, post office address and telephone number of the owner of the mark identified above.
9. The goods and/or services covered by or offered under the mark identified above.
10. The date of first use of the mark identified above
11. The date of first use in interstate commerce of the mark identified above
12. A description of the manner in which the Complaining Party believes its mark is being infringed upon
13. Sufficient evidence that the owner of the website that is claimed to be infringing is a SSK BHARAT BBI user/member.
14. The precise location of the infringing mark, including electronic mail address, etc.
15. A good faith certification, signed under penalty of perjury, stating that:
1. The content of the website (identify website) infringes the rights of another party
2. The name of the said party
3. The mark being infringed
4. That use of the content of the website claimed to be infringing at issue is not defensible
16. The Complaining Party's trademark claim will only be effective upon delivery by the Postal Service or other delivery service to the address provided by SSK BHARAT BBI Private Limited.
